These Terms of Service (the "Terms") govern the use of the Apogeo mobile application (the "App" or "Game"), provided by [CONTROLLER NAME / COMPANY], [ADDRESS], Italy (the "Provider", "we"). By using the App you accept these Terms. If you do not accept them, do not use the App.
By installing, accessing or using Apogeo you confirm that you have read, understood and accepted these Terms and the Privacy Policy, which forms an integral part of them.
Apogeo is a skill-based video game in which you guide a projectile among the stars to travel the greatest possible distance. The service includes a daily leaderboard based on a shared course ("Constellation of the Day"), a friends system and 1-vs-1 challenges. Some features require an internet connection; the core game can run offline, but without submitting scores to the leaderboards.
We may modify, suspend or discontinue the App or individual features, in whole or in part, at any time, including for technical or security reasons.
To use Apogeo you must be at least 13 years old. If you are under 18, you confirm that you use the App with the consent of a parent or guardian. In some EU countries the minimum age to consent to data processing is 16, in which case parental/guardian consent is required.
On launch you are automatically assigned an anonymous profile. You may optionally link an email address (via an OTP code) to keep your profile across devices. You are responsible for the use of your account and for the security of access to your email inbox. Notify us promptly of any unauthorized use.

Scores are validated by our servers: every run submitted to the leaderboards is deterministically re-simulated server-side. We reserve the right to void scores, reset runs, remove entries from leaderboards, or suspend accounts where we detect manipulation, anomalies or rule violations, at our reasonable discretion and without prior notice.
Some elements you enter (in particular your display name) are visible to other users. You are solely responsible for such content and you grant us a non-exclusive, royalty-free, worldwide license to display it within the service (for example on leaderboards and challenges), to the extent necessary to operate the App. We may remove or modify content that breaches these Terms. You can report inappropriate content to support@playapogeo.app; we will act within a reasonable time.
Apogeo is free and ad-supported. You may choose to watch a rewarded video to earn an extra life (maximum one per run). Watching is voluntary and not required to play. The processing of advertising data is described in the Privacy Policy. The App currently has no paid in-app purchases; any future introduction will be governed by specific terms.
The App, its code, graphics, sounds, trademarks and all other content (excluding user-generated content) are owned by the Provider or its licensors and are protected by copyright and industrial-property laws. You are granted a personal, limited, non-exclusive, non-transferable and revocable license to use the App solely for personal, non-commercial use.
The App is provided "as is" and "as available". To the maximum extent permitted by law, we make no warranty that it is error-free or uninterrupted, that the service will be continuously available, or that data and scores will be preserved. To the extent permitted by law, we will not be liable for indirect, incidental or consequential damages arising from the use of, or inability to use, the App. Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including consumers' rights under mandatory law.
We may suspend or terminate your access to the App if you breach these Terms. You may stop using it at any time and delete your account from the Profile section of the App. Deletion results in permanent removal of your data, as described in the Privacy Policy.
If you downloaded the App from Apple's App Store, the following applies: these Terms are concluded between you and the Provider, not Apple; Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the extent permitted by law, Apple will have no other warranty obligation. Any claims relating to the App (product liability, conformity with legal requirements, consumer protection, infringement of intellectual property rights) are the responsibility of the Provider and not Apple. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in an embargoed country and are not on any prohibited-party list.
These Terms are governed by Italian law. For consumers, the mandatory jurisdiction of the consumer's place of residence or domicile and the application of the mandatory rules most favorable to them remain unaffected. For other users, the courts of [CITY], Italy have jurisdiction.
